my daughter was eighteen when given a pbj for second degree assault, with 18 mos supervised probation with counseling. she was to go to see her probation officer jan 20, but left the state jan 16th...she was encouraged to and everything paid for by a much older man she had met on line. now at nineteen, she realizes what a misktake it was and how she was mislead. i have been tring to catch this man for 3 years. if she comes home, is there any way she can avoid jail time...this is her first offense...also, is it a felony for a vlatio of probation

If the judge finds her in violation of probation, then the judge may enter a guilty finding and impose up to 10 years. Second degree assault is not a felony. It is a misdemeanor. It is unlikely that she would receive the maximum, but not reporting to her agent is a serious violation. Who the judge is will affect the disposition. I offer a free initial consultation.

VOP is not a felony, either. But she needs a lawyer immediately to mitigate this situation.
