Legal Question in Intellectual Property in Maryland

Trademark Challenge

I have been using a name for a east coast publication for about 3 years. I have finally gotten around to registering it and found that someone is using the original name and exact font and set up that I used when I started the publication (the font has sinced changed from the original). The other individual just registered the trademark last year. What can I do?

If the registration has issued, you can file cancellation proceedings in the US Patent & Trademark Office. If it is still in the application stage, you may still be able to file an Opposition. Both would require your showing prior use for the same or similar goods/services.
