Legal Question in Medical Malpractice in Massachusetts

I had a stroke

I went to my primary care doc and I was told him I was having a stroke. He told me to get to the hopsital asap and told me which hospital to go to and even called ahead to tell them I was coming. Needless to say, they didn't care and the call ahead didnt expedite anything. I was left sitting in a wheelchair for 2 hours and then put into a room for another 3 hours with nothing being done. I was so frustrated I got up and left. I went home. When I got up the next day, I had a full blown stroke and called a ambulance and they took me to a local hospital with diagnosis of a stroke. Is there anything I can do about hospital #1 since they could have prevented the stroke by giving me a shot to stop it? I would still be sitting there today waiting for help. With my doctor notifying them in advance of my condition, is there something I can do?

Re: I had a stroke

Hi -

At the outset, I need to say that medical malpractice cases are VERY tough to win in Massachusetts. In order to have a successful case, you need to show that the hospital staff somehow did not conform to the "standard of care" they are required to adhere to. The only way to know if they did is with a careful review of the medical records. Sorry, but I am not trying to be the voice of doom and gloom. Rather, I am just trying to be honest and straight with you. From the information you provided, it seems the stroke may have been preventable, and therefore, a breach of the standard of care may have occurred in your case. But, the only real way to know for sure is with a careful analysis of what happened that day. I will be in my office on Monday and would be happy to chat if you want to talk this one out in order to see if this is a case. Thanks.
