Mexican Timeshare contract default

We purchased a timeshare in Mexico. The deal was to trade in our California timeshare and pay the difference in cash. We paid the difference in cash and were transferring title of our CA timeshare to them. The company that they hired to transfer the title never performed the transfer, now two laters. Since they hired the company to transfer the title and it was never done, can we get out of our contract for them not performing their part of the deal? It has been a nightmare dealing with this company. I sent a check to pay for all of the transfer fees and they cashed it and never filed it. The timeshare in CA is still in my name and they are booking families under my name. The transfer never went through so isn't this fraud? How can weget out of it?

Where was all the transaction made? I will give you an answer from the point of view of mexican law: You can sue for the termination of the contract �cause of non-compliance plus the reimbursment of paiments as well as legal fees and expenses. In the sue you can ask the judge to order that they stop all procedures or contracts regarding your property at california. You can request for clarification and get help for your case at www.profeco.gob.mx (Consumer's Federal Attorney). You can ask for help in english. If you don't get help enough, you can file the case in a Mexican Civil Court.
