Pension Benefits

Are city utilities, such as the City of Lansing, exempt from the Michigan law giving spouses an equal share (1/2) of the pension benefits after over 20 years of marriage?

To Whom It May Concern:

This is in response to your email which you submitted on February 9, 2001, and which we received on March 22, 2001.

In my opinion, all pensions including government pensions are part of the marital estate and as such are subject to division between the parties. Often times, government pensions are not divisible via a Qualified Domestic Relations Order. However, they are divisible via an assignment or other means.
