Legal Question in Wills and Trusts in Michigan

Power of Attorney

I was wondering what I needed to get Power of Attorney over my mother-in-law or to give it to her son, my husband. A doctor in Michigan has signed a form saying that she is incapable of making sound decision for herself. I know that there are forms for health care decisions, estates decisions, but are there any forms that will grant power of Attorney to us for anything and everything that might happen in her life and also is the form from a Michigan doctor good in California. Does the form need to be notorized and is notorizing in Michigan good in California.

Thank you for your help,

Loren

Re: Power of Attorney

Loren,

From your email, it appears that your mother-in-law is incompetent to sign any documents, including a durable power of attorney. If so, a conservatorship may be the best approach.

Sincerely,

Re: Power of Attorney

Power of attorney won't work, you need to petition the probate court for a conservatorship. For more info, please contact my office at (248)851-3171.
