Legal Question in Family Law in Minnesota

Name Changing

I would like to change me and my daughter's name to my maiden name now that I am divorced. I have full Legal and Physical Custody of her. Is that possible without the signature of her father?

Re: Name Changing

It's possible, but you will have to file a motion in court and prove that the change is in the child's best interest. At the hearing, the father will have the right to object and make a case for retention of the name. The judge will then decide the issue based on the evidence you present.
