Sue for rights.

Hello, My ex husband hasn't seen our daughter over a year. he hasn't paid child support or had any contact with her since February. Also I have no knowledge of his address only the city he lives in. When would it be possible to take this to court and stand the greatest chance of winning.

Re: Sue for rights.

Miss. Code Annot. 93-15-103 provides in part for termination of parental rights when a parent has made no contact with a child under the age of three (3) for six (6) months or a child three (3) years of age or older for a period of one (1) year. It is a defense to the termination that the parent was obstructed or prevented from having contact with the child.
