Brothers Checking & Savings Accounts

If your name is on your bothers checking and/or savings account and he passes away does it have to go through the Probate Court?

Generally no, but it is subject to challenge depending on the circumstances of your name appearing on the account. If you need a more precise answer now, you will need to sit down with an attorney and discuss it. Otherwise, make sure the personal representative of the estate is aware of the accounts and your ownership as well as the probate judge. Do not keep it a secret. Do not surrender the money to the personal representative of the estate unless instructed to by the probate judge or on the advice of your own attorney.
