Legal Question in Family Law in Nevada

Do we have a case for custody?

We live in Clark County in Nevada. My stepson's motherr is not thinking in the best interest of her son. She reccently moved, because her line in boyfriend beat her up. She called the cops and got a restraining order on him. She told us that he has been beating herr for a while. The most serious beating occured while my stepson was sleeping. She is now renting one bedroom in a house of people she barely knows. My stepson sleeps on a cot in her room. When she is at work, my stepson is watched by her ''friends''. While being watched, he hass been chased around with a knife, gotten into a fist fight, and been driven around in the cargo area of the van with no seatbelt. She is unable to feed him at times and then we supply food. She cannot clothe him in decent clothes. She continues to claim others have molested my stepson when the judge already told her she was wrong. In her last residency, she allowed my stepson to be verbally abused by her boyfriend and their roommate. She discusses her financial problems with my stepson and worries him about eviction. I do not know what to do.

Re: Do we have a case for custody?

It sounds as if your husband would have a very strong case for a change of custody. I would need to speak to you to determine what probable results you may have depending on the original custody order.

Additionally, if your stepson is in immediate danger you could file a Motion with the Court for temporary emergency custody.

My office handles all such matters. If you would like to discuss your case with our office feel free to contact us at the information below.
