Child custody

Still married legally. Spouse in GA with 4 & 7 year old. Original agreement was he kept kids till I got settled in NV. Concerned about welfare of kids from last phone call. Has cut all contact. Do I have the right to go get my kids?

You always have a right to petition a Court to determine custody issues regarding your children as their natural mother.

In your situation, your success in establishing custody in Nevada will probably involve several steps. One, it sounds like you should establish divorce proceedings. This would allow you to petition a Court for primary physical custody.

Second, if you have some form of separation agreement you may have to institute any domestic petitions in Georgia.
