Legal Question in Personal Injury in Nevada

Valuation of injury and pain and suffering

I was in a traffic accident a little over a week ago. The other driver was cited for improper turning. He was travelling west bound, and I was going east, when he made a left turn in front of me. Both vehicles are totaled.

I suffered alot of pain from the airbag, seatbelt, and also the from impact with the steering wheel. I refused to be taken by ambulance at the scene but by the time I was leaving the scene my chest started hurting, which was likely caused by the airbag. I was badly bruised, and swollen. The doctor at the trauma center prescribed pain killers and muscle relaxants. And would have been in severe pain had I not taken these pills. My boyfriend lived just 2 minutes away, had called his friend to come take pictures of the accident scene. So I have pictures to document the accident and my injuries.

Yhe other driver's insurance co. is now doing a valuation of my car which is probably only worth at the most $1700.And have sent me a check for reimbursement of a rental car.

I understand they will also pay for the medical bills I incurred from the accident. My question is how does the insurance company valuate the pain I suffered from this accident? What is a fair claim?

Re: Valuation of injury and pain and suffering

I would say your case is worth in the range of $5,000 to $15,000. However, without an attorney you probably will be offered about $2,500. I would suggest getting an experienced personal injury attorney. Also you do not want to settle your case to early. Make sure you know the nature and extent of your injuries. Once you sign a Release for your personal injuries you will not be able to come back to the insurance company for more compensation.
