How can we avoid probate?

My mother just learned she is terminally ill and is not expected to live long. Her only asset is her home valued at about $100K or so. She wants to transfer the two mortgages on the house to a gentleman who currently rents the house from her. It will take 30-60 days for this person to obtain financing and close. My mom is not expected to live more than a week or so. How can we avoid the house going to probate? Our goal is to get the ownership of the house and financial obligation transferred over to the new owner.

I suggest creating a Living Trust and immediately transferring title to the property to the trust. Upon your mother's death, the successor trustee can proceed with the transaction.
