Tenant signed giving 30 days notice will be out by end of Dec. -unit has been rented to new tentant as of Jan 1, current tenant not paying rent and doesn't want to leave at end of month now

You have offered very limited facts. However, the general rule is that you will need to commence an eviction action in District Court to evict the current tenant. I seriously doubt you can get legal process in place in order to deliver the premises on January first. I suggest that you contact an attorney in order to conduct a more comprehensive review of your situation and to seek a workable solution.
