Legal Question in Landlord & Tenant Law in New Hampshire

NH - Landlord has tenant who needs to be evicted. Tenant is at will, but called code enforcement before landlord could evict. Tenant is being malicous to other tenants and really needs to go. Hasn't paid this months rent yet. How can lanlord evict tenant without it looking like retailiation for calling code enforcement?

The case is not driven by appearances, but by facts. Was the code violation allegation justified? Did the Code Enforcement Officer take any action? Was the rent current at the time of the report?
