Legal Question in Credit and Debt Law in New Jersey

Any chance for Reimbursement?

I was hit with a wage garnishment from Citibank. I fought the wage garnishment and the court overturned it because I was not properly served. The former room-mate signed for the papers and I never saw them.

a piece of property I sold was attached by Citibank and $8,000 was taken from the proceeds of the sale during the ID Theft investigation in April 2005. Citibank supplied documentation indicating the account was in fact fraudulent and deleted the trade line listings from my CRA. Citibank made a verbal agreement in 2005 to reimburse the funds taken inappropriately. When no payment arrived within 60 days, I followed up being told the only way to be reimbursed is through a suit. I did not have the funds to initiate a law suit against Citibank.

Is there anything I can do that won't cost me thousands of dollars I don't have in legal retainers?

Re: Any chance for Reimbursement?

You might maybe be able to convince an attorney to take this on a contingent fee, depending on the facts. Not clear what the results will be if you file suit, but sounds like you should get your money back.

Did the court judgment against you get voided?

Call me if you like; the initial phone call will be free.

Re: Any chance for Reimbursement?

They are full of crap! WRITE them, give them the info the person receiving the letter will need to look things up, and DEMAND return of the money with reasonable interest immediately. Double-check your credit report to be sure any negative reference has been removed (they OFTEN do not get it right, and even when removed, it OFTEN ends up back on your credit report - Why? Because the system is set up to screw the consumer and allow creditors to charge them more). Tell them they have 14 days to respond, and insist upon responses in writing, even when they call you. If they do not put things in writing, you write to them stating, "This letter is to memorialize my conversation with _____ on ____ 2007, where they promised X and I was to do Y (if anything). Send ALL correspondence First Class & C.R.R. mail! Good luck & be persistent!!! If they do not perform, sue in Special Civil Part yourself if you can not get an attorney, and ask for costs, fees, interest, punitive damages, legal fees and "such other and further relief as the Court may deem just and appropriate."
