Legal Question in Credit and Debt Law in New Jersey

How can I protect myself from being responsible for my husbands credit card debt

I am not listed as a co-user. If he should pass away, will I have to take savings to pay them off?

Re: How can I protect myself from being responsible for my husbands credit card

Your question is simple, but the answer is not. Things that may make you liable for a spouse's debt include: is the purchase a 'necessary', that is a thing or service deemed necessary for your spouse or children? (Porsche convertible is probably not, peanut butter and jelly probably is); did you sign on the credit card application? (most people dont remember for sure, so ask the credit card company to produce the application before you agree to pay). YOu also indicate that your spouse may have assets in his name; the laws governing paying a dead person's debts are a little complicated, but generally you have to take steps to prevent the person who inherits the money from being stuck with the bills.
