Legal Question in Employment Law in New Jersey

My employer is avoiding me because he hasn't paid the entire amount that I should have been. He paid partial amounts from Jan 2010 and the entire back log of payments from his side is around 25000. What do I need to do to recover my money from my employer? I have tried to send multiple emails, I have called all the people in the company and nobody is responding. The amount on the pay stub doesn't match the amount they have paid me so far in this year. They did not even pay partial amounts for three pay periods, I have sent all approved time sheets as a consultant on time. My agreement is based on 80-20% on the billing rate and they are not responding.

What can I do?

New Jersey has a wage payment law that requires an employer to pay you what you are owed on a timely basis. However, based on a couple of things you state in your question, I am not sure whether you are an employee or an independent contractor, working for a percentage of the amount you bill. If that is the case, you are not covered by the wage payment law but may have a contractual claim against the company. In any event, you should talk with an attorney who will review the facts and advise you on the best course of action. Feel free to call me if I can help you.

I have had success in suits for back pay in situations of this type. With the large sum owed, it seems that a suit is worth doing if you have not had any success by other means. Call or email and we can discuss the details. /p/ See also: http://info.corbettlaw.net/lawguru.htm

You need a lawyer to demand that he pay you all of the money, now. And you probably will have to sue him. Give me a call, 201 820 3460.
