Property Never Probated

How can I claim or title property that has never been probated? Father in law passed away over ten years ago and probate has never been started. Property real and personal consists of four empty lots of which I have paid the delinquent property taxes on for the last four years. How can I take possession of this property? All other heirs will waiver their rights to property.
