Legal Question in Family Law in New York

closed case put back on calender

I live in Georgia, my ex lives in NY. Our son chose to live with me whe we got divorced. We both waved any child support as part of the divorce agreement. Our stipulation agreement states he is emancipated if he does not live with the costodial parent (me). When he turned 18 and graduated high school, he decided to live with his mom. She filed a child support lawsuit.

We negioated a settlement, and her lawyer failed to file it by the deadline. The case was dismissed and closed for that reason. 45 daye later I recieved court papers informing me that it has been put back on the calender (same docket #). Is this legal? Don't they need to file a new case? Are there any lawyers in Cattaraugus County who can help me?

I am confused about where your case is pending. If it is in NY, I can't help. If it is in NY, you need a NY attorney.
