trial separation question

If a couple in New York State is considering a trial separation, is there any legal papers that have to be signed or prepared or can one spouse move out. Without any papers can the other spouse claim abandonment.

New York law does not make provision for a "trial" separation, but does recognize voluntary separation under a written (and notarized) separation agreement. It's a reasonably complex area of the law - one which requires careful planning, particularly if there are children or substantial amounts of money or property involved.
