Legal Question in Employment Law in New York

Where should I file suit?

I left my former employer and received a letter saying that I was being allowed to keep my vested stock options, per my options agreement. However, after I left, my former employer accused me of violating the options agreement non-compete clause and rescinded my options. The options have no value as the company has not yet gone public. I have reason to believe that I should have these options returned to me (i.e. I was not violating the non-compete). Given that the options currently have no value, can I go to small claims court with this case? If not, in which court should I file suit?

Thanks!

Re: Where should I file suit?

No! Small claims court does not have the power to give you injunctive relief. You will need to file this at Supreme Court if it's in New York.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
