Legal Question in Employment Law in New York

unemployment

my unemployment benefits were contested by my former employer. They claim misconduct on my behalf, such as absences, but i have a 9 yr son in a residential school because he has autism. I missed the hearing for this case because i had to pick my son up.I was fired 2 weeks after i filed for the family leave act. I was also granted information on a hazardous material explosion at the work site. In addition to this my health benefits through the company were canceled within a week of being fired. To my understanding health benefits cannot be canceled until after 30 days. I would like some guidence in this matter because i have 4 children and no income right now.

Re: unemployment

That sounds like a horrible situation. I represent people in situations such as yours by negotiating severance packages for terminated employees. In your case, it sounds like you may have been retaliated against for filing your FMLA claim, which is illegal.
