Legal Question in Employment Law in New York

Unemployment claim

My husband was suspended wrongfully due to another employee who has personal issues with my husband. My husband fought this matter, he was successful and then was asked to return to work. On the 8th day at work he was told that he is now terminated as they realize they no longer have a poistion available for him. Now, my husband is definitely seeking counsel to represent him, in the meantime he wants to file for unemployment. My husband is worried that when he enter his reason fr termination as position no longer available, he is worried they will deny it and state he was insubordinate (which was the first reason for suspension) which was not true at all. And getting any type of document saying so from his employer will be impossible. What should he do?
