Legal Question in Employment Law in New York

work 48 hours - paid for 40??

I work 4 12 hour shifts dispatching trucks every week. My paycheck for the last 4 years only shows 40 hours. I am not salary, as I do not get paid if I am sick or take a personal day. No one will give me a straight answer at work. In 4 years, I almost have another year salary at 10 weeks a year. 52x8hours=416.

Not even counting it as O.T. - just straight time.

Re: work 48 hours - paid for 40??

As you are aware, federal and New York state laws mandate time and a half for hours worked over forty hours per week. If the facts are indeed as you say they are you may be entitled to OT pay. Please call for additional information.
