Legal Question in Personal Injury in New York

slip and fall

my 12 year old daughter walked into a sams club store yesterday in which the foyer part of the store was soaked with water carpets,floor all of the area. no one was mopping it up,no wet floor sighns out nothing. she was holding her year and the half old sister as well in her arms. m 12 year old as a result of the soaked floor at sams club slipped and fell down her knee is a bit sore and bruised. a woman employee of the store watched her fall and told me that I should fill out a injury form with the store which i did. the manager was not very kind to us at all after i asked to fill out a injury form and he wanted to know who told me to fill out a injury form, what can we do, if anything?????

Depending upoon the severity of the injury, you may have a liability claim against the store. Call me if you need further direction.

There are 2 parts to this case: liability and damages. Liability is clearly there - the store either knew or should have known of the dangerous condition. However, the second part, damages, in more questionable. A skinned knee will not be enough. Did she see a doctor? Were x-rays taken? Does she need to follow a course of physical therapy? This would all have relevance in determining if she has a valid claim which can be pursued. This is the type of matter my office handles on a regular basis.
