Legal Question in Personal Injury in New York

uninsured car accident damages 2

If the car I was driving is uninsured

then I thought NYS would be

responsible for the damages to the

other persons vehicle b/c NYS is

suppose to ensure that the all drivers

in NYS have insurance. Am I wrong?

Also shouldn't the owner of the car

be responsible for damages and not

me?

I think you refer to the Motor Vehicle Accident Indemnification Corp., (Insurance Law Section 5201 etc.) This is a quasi-State agency set up to step into auto accident cases and act as the insurer for an uninsured vehicle (to a limited extent). A proper, and timely, claim must first be made by the victim. MVAIC can step in to provide personal injury and property damage protection to "financially irresponsible" motorists, meaning the owner and driver of an uninsured vehicle. However, there may still be issues with the driver of the uninsured vehicle, if that driver has insurance of his own. If such insurance exists, either auto or homeowners, I would recommend notifying the carriers promptly. Best, M. E. Zuller
