separation and divorce in NC

1 When husband says he is thinking about filing for divorce and wife is main source of family income, what can she do to secure finances and start saving money he will not be aware of?

2 If both parities work but wife has higher salary, 4 yr old child nvolved will be staying with mother, and hsuband is moving to Fl, will wife have to make payment to husband?

3 Is it absolutely necessary or best judgment to hire divorce attorney even if both parties appear capable of reaching aimicable separation agreement and can compromise for divorce?

(1) You can't save money that he will not be aware of. Once you are legally separated, you will have to disclose all of your income and assets. It is unethical to hide marital funds and such fraud could be the basis for re-doing any agreement you reach.

(2) You could possibly have to pay spousal support (spousal support is not gender specific). But he will have to pay child support - could be an offset.

(3) Absolutely hire an attorney. When people try to do it themselves, sometimes it is ok. But the sometimes it is not, I have seen people represent themselves only to lose a ton of money and agree to things that are not reasonable under NC Law.
