Legal Question in Personal Injury in North Carolina

Release of Liability

My son is living in our old house. This house has a 27 ft pool. My son has also added a trampoline.

I need a form that can be signed by anyone using the pool or trampoline saying that I or my insurance is not liable in case of injury.....thanks

Re: Release of Liability

There is no "magic" language to be used in this sort of release (technically a "pre-injury" release). You should probably consult a lawyer for a form with all the "bells and whistles." You can run a Google search on "pre-injury release" and eventually should be able to find some language. More importantly, however, you should be aware that this release will probably not protect you from claims from minors (i.e. under 18), who are probably mostly going to be using the trampoline. They do not have the legal capacity to sign a release, and their parents cannot release you from the minors' claims. You could require their parents to sign a form saying that they will indemnify you, but that's a different matter. If you're concnerned about this, you may want to consult a lawyer to discuss your options.
