Legal Question in Personal Injury in Ohio

Our attorney doesnt know how much to ask for?

3 years ago I was badly injured at a retail store. Theie corporate admitted neglience and total fault on themselves. Our attorney told us yesterday that he did not know how much to demand for settlement? I am suffering from left side brain damage, (moderate damage) Post migraine syndrome, Post concussion syndrome, A broken neck (Healed) CRPS in my right shoulder. My Neuoro-Psychologist said before my accident I was at 78% of the work force (Very Good) After the accident right now I am at 19%. Also I have Dis-Association Syndrome? Said I am almost totally disabled. Plus I have 3 bulging disks in my neck. All injuries are perm. and I have to take meds every night and I can not have children! I am 25! My attorney says he needs help figuring out the demand price...Why? Should I be concerned?

You have so many complications from this fall that it may be difficult to determine what it is worth. Only going by the info you have given, I would ask for at least $250,000.00

You need to determine what amount of money seems fair and reasonable to you and the liklihood of the company's ability to pay that amount.

You have so many problems that he is having a hard time fixing a price. You need to come up with some number that you can walk away feeling okay with...that's hard but you need to...if you can't then the jury will come up with one themselves.

The many elements of damage that you specify need to be evaluated individually, just as if you are presenting case to the jury. I have used a vocational economist to determine loss of future income. A medical care planner can project future medical expenses. And there are experts available to determine "hedonic" damages, that is, loss of enjoyment of life.

If your attorney does not have access to these types of experts, please encourage him to associate with co-counsel. I recently co-counseled in a case in the Ohio Court of Claims, resulting in a million dollar settlement. It is never easy, you must prepare your case and have a solid basis for the dollars demanded.
