Legal Question in Personal Injury in Ohio

Inmate injured while working in prison kitchen.

I Don't know if this the right forum to ask this question but I don't know where to turn. My son is incarcerated in an Ohio State prison, while there he was working in the kitchen and from what we understand, there was an accident, he apperently was electrocuted, he suffered a stroke from the accident, he is 27 years old and due to be released in june. This accident happened early this year. We have just learned of this and he is unable to care for himslef and will need us to care for him. Our question is this, is the prison or state liable for this injury? Is anyone? we ask this because the cost of care is going to be alot more than our income can afford, so is there any form of help or any legal ramifications for the state to get them to help us afford the costs of his care? We have learned that they have applied for social security on his behalf. As I stated before, we have just learned of this and are trying to get our bearings....any help will be greatly aprreciated.

Jeff,

Generally, the state can not be held liable because it has immunity. However, there are specific instances in which the state can be sued. You will need to sit down with an attorney and explain the facts to him or her. Most attorneys offer a free initial consultation. Other options you can explore applying for Medicaid to help pay for medical bills in th event that this is not being handled along with the social security disability application.

I am truly sorry to hear about your son's injuries. The fact that he ended up in prison is bad enough. He certainly did deserve to come out totally disabled!

I can not tell you what the proper remedy will be for your son. I will need a lot more information. Is he still in prison? Were there any witnesses to the event that led to his injury? Have you seen any reports from the authorities? Would it be possible to talk to him directly?
