Legal Question in Personal Injury in Ohio

judgement collection

I was awarded for an accident. The person married since the judgement. Can her spouse be held liable for the debt to? I was liable for a student loan of my wife's that she had before we where married. They took our tax return for three years to settle that debt. This debt is from an accident that she caused. the judgement was changed to a higher amount after she was married. This was in summit county ohio and i now live in Illinois. thanks

Re: judgement collection

It is highly unlikely that you would have any right to collect against any of the new husband's assets. The judgment is against the person who caused the accident. You will have to try to find a way to get her to pay. Did she have insurance at the time of teh accident? If not, was the BMV notified?

I doubt that there is much that can be done but I will be happy to talk to you and get additional information if you want to call. No charge or obligation for the confidential call.

Good Luck!

Re: judgement collection

from the facts you have given, I don't think you can successfully recover any of the judgement from the new spouse.
