Legal Question in Immigration Law in Oklahoma

Hi there,

I am on H1 Visa, i have found a new employer who offered me better pay and better benefits. My question is: What are the company's requirements to have employees on h 1 visa? for example, is it based on their annual sales? Thanks

Hi,

There are no minimum requirements in terms of sales or profits or number of employees. The company should be able to pay the H1B beneficiary the offered salary for the specialty occupation described in the H1B petition, however.

There are several issues that are relevant when it comes to processing H-1B's. There is no minimum sales number but the company has to be in a position to pay the prevailing wage for the position offered.
