Legal Question in Credit and Debt Law in Oregon

i just got a notice for small claims in regon from a collections agency in regards to a medical bill 3 years old. i dont have the money to pay them and i'm very scared i even had to sign to to get this notice. I'm not working right now so i dont have the money to get them to not take me to court what can i do?

It sounds like you were served with a Summons and Complaint in the small claims action. This means that you are summoned to court on the date and time indicated to answer to the claim that you owe money. Your choices are to go and answer to the claim of not go. If you answer to the claim you will have to file a response to the claim against you. You can usually file a response to the claim and request that the court waive the charge to file the response (called a fee waiver). Then you present your arguments to the court as to why the claim is not valid. If you decide to do nothing the collections agency will obtain a default judgment against you. This means that they win and the have a judgment that they can enforce against you. Before you decide what to do, if you do owe the money,you should call the agency and negotiate a payment plan.
