Legal Question in Criminal Law in Pennsylvania

stealin mail and applying for credit

in 2005 a state trooper came to my home saying that he had a search warrant and that i had to allow him in my home. i never saw a search warrant. he stated that in 2004 i stole my next door neighbors mail and applied for credit in her name and ordered her merchandise. i told him i did not such thing. i told him i do not speak to or bother with them at all since their 2 german shepherds attacked me and mauled my small dog. he said that i reported them to animal control and i said i did and had every right to do so. he said that i was harrassing them & steaking their mail. he said he was looking for a computer. i said i did not have one just a web tv system that had no been used in a year. he took it and gave me a receipt. he said if i did not admit to stealing her mail that he would go to my work and family members and take their computer. i did not ever hear about this matter until april 2008 when i received a criminal summons to appear in magistrate court for felony theft-misdemeanor use if an access device. the case was dismissed. the another state police said he will refile the charges. my attorney said they have no evidence. no record of any transaction taking place on a computer. how many times can they refile & can i sue the

Re: stealin mail and applying for credit

You can sue anybody for anything. Usually what people mean when they ask this question is can they win a suit. That's difficult to say. Police are pretty well protected against malicious prosecution claims but there is a limit. The attorney that represented you before the Magisterial District Judge is in a much better position to evaluate any case that you might have either against the police or against your neighbors.
