Legal Question in Civil Litigation in Pennsylvania

civil court statements

I am going to take company to civil court over dealing with trying to rip me off etc.... my question is, one of my witnesses can not make it to the courthouse do to health reasons...so, can he write a statement and sign it and will it hold up in court ??? if not, what can i have him do? thanks !!!!

It probably will not hold up. The opposing party has the right to confront witnesses. How do they ask a piece of paper questions?

The alternative is to hold a deposition. A form of discovery where the witness is asked questions on the record by attorneys for both parties. The deposition can then be entered if both sides agree.

Another possibility is to ask the court to allow the witness to testify by telephone. This can be done by getting the other party to agree or have the court issue an order allowing for telephone testimony.

You likely want to take his deposition and subpoena him to appear at court that way the company will be able to question him for the record.

Yes you likely need an attorney to help you get his statement in.
