An out of state resident can be sued and served properly in some cases. But, your question should be, 'what do I do now?' Answer: Hire a local attorney to sort this out before you get judgments or warrants against you. Either that or come into the CA court case with motions to quash, strike, or whatever is appropriate on your facts and issues. Feel free to contact me if serious about getting legal help.

The only time a criminal punishment can be imposed in a civil case is when you are in contempt of court. Normally a failure to answer results in your default being taken. You do not tell us what the two states are and what the civil suit is about; from the information you give, it does not seem that the outcome you claim exists could occur, so you need to check out everything to besure what is going on.
