Legal Question in Medical Malpractice in Pennsylvania

My 16 yr old daughter had xray from regular dentist. After oral surgeon's did one, he found cyst on her jaw. After getting original xray, it was there. Original dentist never said anything. Now she has permanent numbness on her jaw and has to undergo surgery. Is original dentist liable for malpractice?

If the condition worsened due to the delay, and the condition should have been picked up by the first dentist, yes there is a malpractice case. The final cosideration is what damages were caused by the delay. I would be happy to discuss this with you further. Please call for an appointment.

Doubtfully, it probably isn't some thing a general dentist looks for. Getting one to say that it is in a letter of merit will be very difficult. Good luck.

you may. You will have to prove that the error caused the harm that she now has. If she would have had the harm in any event, than you would not have a case, although thdre would be malpractice.
