Legal Question in Personal Injury in Pennsylvania

auto accident

my son was injured in an auto accident (not his fault)but we had limited tort at the time.he was in intensive care for 3 days due to head injuries (brain swelling) and discharged after 5 days.would it be worth it to try to sue for the time spent in intensive care? thank you for your time on this matter. P.s. we now have full tort.

I believe you should try to recover against the person who is at fault. Generally you cannot recover money with limited tort unless the injury is severe. Exactly what is a severe injury is a hotly contested area between plaintiff attorneys and defense attorneys. I think, however, in your case if your son was hospitalized in intensive care for several days you might be able to overcome the severe injury requirement. You should contact an attorney to discuss fully everything that has happened. In PA you only have two years to file a lawsuit to preserve your rights.
