was involved in auto accident was physically hit by auto driver was uninsured suspended license not even owner of car person owned car was deceased and no insurance i have insurance but not full torte sustained bodily injuries is there any legal action i can take against person driving vehicle

If you are covered by the limited tort option and there are no exceptions which apply to your case, you can only recover non-economic damages (pain and suffering) if you demonstrate that you have sustained a significant bodily impairment. Nonetheless, you can recover economic (out-of-pocket) damages. You would need to recover this money directly from the negligent driver (not likely) or your own uninsured motorist coverage.
