Legal Question in Traffic Law in Pennsylvania

safety belt

As I pulled up in front of my sons elem school the other day an officer looked into my window and informed me that because I did not have a booster seat for my 7 yr old that I was in violation and would be getting a $100 fine in the mail. He took down my plate number and walked away.

I searched for laws in PA regarding seat belts and what I found was he can not ticket me for this violation without making a traffic stop and then citing me as a secondary offense. Is this correct?

You asked about a ticket by mail.

I absolutely love citizens such as yourself. If and when you get that ticket send back your demand for a hearing with a copy of the statute. (I truly wish you could find that cop, shove the statute in his face and do a little jig while singing sc___ you buddy boy).

But that would probably get another ticket for another stupid violation of the anti-dancing on the sidewalk ordinance. And it would be childish (but you do want to do it, don't ya?)

If the prosecutor doesn't drop the charges then appear and present the statute to the court.
