Most carriers and employers require a resignation from employment as a condition of resolving a case. One reason is to preclude any future Workers' Comp expenses. Another erason is to prevent any federal or state employment law lawsuits like ADA, family medical leave act, Title VII, pregnancy discrimination, equal pay, etc.

Good Luck.

Not unless you agree to resign as part of the settlement. It is not required by law and the Workers' Compensatio Judge has no jurisdiction over your emloyment status.
