You did not state whether you are the father or the mother of your alleged daughter. Nevertheless, if you are the mother and since you are not married to your partner then you have the parental authority and custody of your illegitimate child. Moreover, the custody of a child below seven years old belongs to his/her mother under the Family Code.Thus, you have the right to the custody of your daughter.

If your lived in partner refuses to give the child then file a petition for habeas corpuz so that you can get the immediate custody of your daughter.
