Legal Question in Family Law in South Carolina

No progress towards divorce

Physically seperated one year as of 11/01/01. No signed seperation agreement. Verbal temporary consent order agreed upon 11/9/01. Other side fails to submit correct document after 3-1/2 months. Other attorney has been called, and faxed regarding this document. No response after 1 month. There are only 3 items concerned. A final seperation agreement not on table yet, waiting for this to be nailed down. Other party does not want divorce, denied 1 year seperation over 11/1/01, maintaining 3 instances of marital relations ending 4/1/01. Joint custody verbally agreed upon by both clients and attorneys, after filing for an emergency hearing. Hearing cancelled based upon this agreement. Since custody is not nailed down, and a seperation agreement is nowhere in sight, would a bifurcation jeopardize custody position, and if so, what other measures can be taken to speed the divoce process. This has the potential to go on forever if nothing is done.

Re: No progress towards divorce

The is very difficult to answer. In the future please enter complete sentences. Your question is hard to read, but I'll try. First of all, I don't understand what, "Verbal temporary consent order agreed upon 11/9/01" means. Was there an order or was there an agreement? The sentence states both. Then you say that the other attorney has been called and faxed regarding this document, but "no response after 1 month" What document? Are you referring to a consent order or an agreeement? You then state that there are only 3 items concerned. What three items? Its hard to tell from your queston. You then say "denied 1 year seeparation over 11/1/01" What does this mean? Your first sentence says you were physically separated one year as of 11/01/01. Have you been separate one year or not? You then ask if a "bifurcation" would jepardize custody. But you never state what would be bifurcated. Then you say" and if so, what other measures can be taken to speed the divorce process?" This is confusing too. Are you saying the a bifurcation would speed the process? Why do you think that? Look, I would love to help you, but you need to take the time to type out your question in complete sentences fulling explaining your situation. Right now, it barely makes sense. Good luck.
