Legal Question in Civil Litigation in South Carolina

co-signer obligation

I co-signed a Sallie Mae loan for my ex-husband in 2002. Divorce was final year ago Halloween. He has not been making monthly payments and Sallie Mae wants me to pay them. Can Sallie Mae take my social security payments to pay off this loan? My name is changed; my account is new and not old account we had when married, etc.

Unfortunatly, not every lawyer knows every area of the law. Personally, I do not know if they can touch your SS benefits, but I doubt it. What I am coureous about is whether he was suppose to pay the loan per the divorce order. If so, then he can be taken back to family court to enforce it.
