Legal Question in Employment Law in South Carolina

wrongful termination

is it legal for a company to fire you without documentation for the reason in which you were fired? also is it legal for a company not to ask the person in which they are firing for their side of the story and base judgement on that alone and not on authority?

Re: wrongful termination

In South Carolina, unless you have a contract of employment, the general rule is "employment at will" which means an employer can fire you, as the saying goes, "for any reason, a good reason, a bad reason, or no reason at all." There is no general requirement for an explanation of the reason for the termination. However if you have reason to believe that the termination was based on an improper reason - race, gender, national origin, etc. - you should definitely speak with an attorney immediately to protect your rights. If you've been discriminated against based on a protected ground, you must file a complaint with the EEOC within 180 days, or 300 days in some instances, in order to protect your rights.
