Legal Question in Family Law in Tennessee

My husband has a daughter that resides in TN. She will soon be arrested, I think, from what we are told. What does he have to do it get his daughter and keep her with him permenantly. Child support has been ordered the the attorney general's office. My husband is on the birth certificate. Can the mother's new husband keep the child. Thank you

Re: custody

The biological parents have first right to the legal and physical custody of their child. If the Mother cannot keep the child, then the Father has the next best right. The step-father has no rights to the child at all if he has not adopted her.
