Legal Question in Credit and Debt Law in Texas

my vehicle in repo status

I'm having major problems with the bank that financed my vehicle with. I purchased the vehicle six years ago. This past January I requested the total amt due so I can pay them the balance, I wrote them a check and on the check I stated final payment. Now they are saying that I still owe them money. The problem is that I switched insurance two years ago and they claimed the info I provided is not adequate. I owe for two years of coverage on my insurance. The last time I received anything in writing was last year on the issue of the insurance. It's been going back and forth for two years now. It's at a point now, where they have put a repo status on the vehicle. Is there anything I can do?

Once I had a client with a similar situation, and what should have been easily resolved with a certified letter, eventually led to a lawsuit with a verdict in the client's favor.

Not knowing your jurisdiction or bank involved, the logical answer is to send them a certified letter contesting the matter, and setting forth the reasons.

Be prepared to file suit on the contract. My client was awarded attorney fees, but there is no guarantee, so you may win the battle, but lose the war.
