Legal Question in Criminal Law in Texas

Subpeona

I am the only wittness to a charge that a man is being tried for and got a subpeona in the mail to attend. I live in Baltimore, the case is in Houston, Texas. Do I have to cover the expenses on getting there? Do they re-imburse my flight costs? Can I give a deposition here in Baltimore instead of flying there. I am just concerned with the airfare cost of getting there, what should I do about this. I would like to testify but not really pay for the trip.

Contact the state's attorney and discuss the matter. A deposition will not likely suffice since a criminal defendant has a right to confront a witness against him (that is to have his/her attorney question you on the stand). Ordinarily the state will evaluate the matter and make a decision whether to bear the costs to transport you. Other matters apply. If you simply choose to do nothing then you may be held in contempt and penalized according to the law of the state (Texas in this case). You may be entitled to other cost reimbursement; contact an attorney should you encounter difficulty.

You should contact the attorney who subpoenaed you at the phone number and/or address on the subpoena. They will then make arrangements for your travel expenses.
