relocation with child

My sister live in Tx. She has a child with a man that is not her husband. She wants to move back to MA. Does she need his permission? He is named on the birth certificate.

From your question, I take it that there are no current court orders regarding the child.

She should consult with an attorney before the expense and effort of moving. Even if she is not currently restricted to Texas, the husband could immediately go to the courthouse, file a petition, get a hearing, and force her back with the child, for the court to determine conservatorship and restrictions. I do not know if MA has a residency requirement before she could file there, to establish jurisdiction over the child.

Absolutely.

If there is a father who has legal rights, and she did not get his permission or the court's permission, she can be in trouble.
